1) Application

These Online Shop Terms of Delivery (“Terms”) are applicable to the online shop owned and operated by Reima Oy (“Reima” or “We” or “Us” as the context may require) at the URL-address www.reima.com/int (“Shop”) and to transactions for Reima products (“Products”) concluded at the Shop.

Your contracting party in all transactions concluded at the Shop is Reima Oy:

Reima is entitled to modify these Terms at any time. Such modified Terms apply to orders that are made on or after the effective date of the new Terms.

BY USING, ACCESSING OR ORDERING PRODUCTS FROM THE SHOP YOU ACCEPT AND AGREE TO THESE TERMS. By accepting these Terms, you also acknowledge that we can send you e-mails and/or text messages related to your order.

2) Becoming a customer and ordering

Please note that orders at the Shop can only be placed by non-trading individuals. Therefore, We will not accept orders placed by companies, associations or any other kind of legal entity.

We deliver Products through this Shop only to the countries listed at https://www.reima.com/int/shipping. Please note that certain territorial restrictions apply and are further specified at the above-mentioned site. You may access the Reima online shops delivering to other countries by choosing another shipping country on the site.

For ordering Products at the Shop you must

  • inform Us of your name, address, phone number, e-mail address, payment details and other required information for the transaction;
  • be of full legal age (18 years or more); and
  • be the lawful owner of the debit/credit card used for the transaction.

If you create your own account at the Shop, you will at the same time create personal user identification and a password. You must maintain your user identification and password protected at all times. You are personally responsible for all transactions concluded using your account and identifications, and shall inform Reima without delay in case your user identification and/or password have come to the attention of a third party, in which case Reima reserves the right to close down or delete your user identification without any prior notice.

We process your personal data in accordance with https://www.reima.com/int/privacy-policy. Personal data and payment information are processed by using a secured connection.

You are responsible for providing current, complete and accurate purchase and account information for all transactions made at the Shop. You are responsible for promptly updating your account and other information, including your email address and debit/credit card numbers and expiration dates, so that We can complete your transactions and contact you as needed.

3) Product information and availability of Products

Before ordering Products, you must ensure that the Products are fit for your intended use. You can use the Product and size information available at the Shop for verifying this. If the content of the Shop is different compared to information provided at another internet site or other source of information, the content of the Shop at the time of purchase prevails.

All descriptions of Products are subject to change at any time, without notice, at our sole discretion.

We make every effort to display as accurately as possible the colors and images of the Products that appear on the Shop. Because the actual colors you see depend on your monitor, We cannot guarantee that your monitor’s display of any color will be accurate.

Although Reima tries to indicate the current availability of the Products accurately at the Shop, Reima does not warrant the availability of the Products advertised at the Shop. All orders are subject to Reima’s acceptance and availability. Reima reserves the right without any prior notice or liability to change, suspend or discontinue the manufacture and sale of any Product.

4) Prices, shipping costs and taxes

The price charged for the Product is the price effective at the time you place your order as indicated in the details of your shopping basket before proceeding to payment and as confirmed in the order confirmation. If the price at the Shop is incorrect due to an obvious typo or other comparable mistake, the incorrect price is not binding on Reima.

Reima is entitled to change the prices without any prior notice. Changed prices apply to orders placed after the price change has become effective.

Shipping costs will be charged in addition to the price based on the selected shipping method. Shipping costs to the chosen shipping country to be charged from you are shown in the details of your shopping basket before proceeding to payment. You may review available shipping methods and associated costs at https://www.reima.com/int/shipping.

Prices and payments are in Euro.

Countries within the European Union

For orders shipped to countries within the European Union, prices are inclusive of value added tax and other applicable taxes.

Countries outside the European Union

For orders shipped to countries outside the European Union, prices shown at the Shop are exclusive of all taxes and duties. Please note that you may have to pay sales taxes or other additional taxes and/or customs duties levied by your country of destination. You may also be required to pay a customs clearance fee for the shipment. These charges are separate from the price charged by Reima and are levied once the shipment reaches the specified destination. Reima does not collect these charges.

To avoid any unexpected charges, We advise you to contact your customs office and ask about import regulations and restrictions as well as applicable taxes and duties before placing your order. It is important for you to become familiar with customs policies for your specific country or location before ordering. Customs regulations differ by country, and not knowing the applicable regulations can result in your order incurring high import duties, the delivery being delayed or even returned.

You are responsible for complying with the laws and regulations applicable in the country of destination, including but not limited those regarding customs procedures and payment of the applicable duties and taxes.

5) Use of promotional vouchers

You can redeem promotional vouchers, issued by Reima in connection with marketing campaigns at the Shop during the period of validity specified in the voucher. However, the promotional vouchers may only be redeemed in accordance with their terms, and limitations may apply to the use of such vouchers. For example, certain Products may be excluded from the scope of the voucher, and thus the voucher may not be used for the payment of such Products.

Promotional vouchers can only be redeemed before completion of the order process. It is not possible to use the voucher after the order has been submitted.

Only one promotional voucher can be redeemed per order. In case the value of the promotional voucher exceeds the value of the order, any remaining balance shall not be reimbursed.

If the value of the promotional voucher does not cover the value of the order, one of the other payment methods available shall be used to settle the difference.

Please note that if you decide to return the Products paid with the promotional voucher in whole or in part, only the payment made by authorized credit/debit card, or other accepted payment methods, shall be refunded. The value of the promotional voucher shall not be refunded.

6) Processing the orders and conclusion of the contract

Your order is an offer to purchase the Products listed in your order. We may choose not to accept orders in our sole discretion. When you place an order to purchase a Product from Reima, We will send you an e-mail confirming receipt of your order and containing the details of your order. This e-mail is acknowledgement that We have received your order and does not confirm acceptance of your offer to buy the Products ordered. We only accept your offer, and conclude the contract of sale for the Products ordered by you, when We send the order confirmation to you by e-mail (the “Order Confirmation”). We recommend that you keep the Order Confirmation for possible further use as the Order Confirmation is your receipt of the purchase.

Please note that unfortunately We are not able to do partial deliveries. Hence, in case some of the Products ordered by you are out of stock, or in case We are otherwise unable to confirm your order as a whole, We will send you an e-mail notification stating that We are not able to accept your order. In that case Reima refunds the payment it has received for the Products. The refund is processed within 14 days from the date of the aforementioned e-mail and is made in the same payment method that you have used when you ordered the Products. You will not incur additional costs for refunds. Alternatively, you may contact our customer service and ask for the refund to be done in the form of a gift voucher, which may be used for the payment of your new order at the Shop.

7) Payment

Please see https://www.reima.com/int/payment-methods for details of the available payment methods. Our customer service may contact you to verify your order information and order details.

8) Delivery

The estimated delivery time for the ordered Products varies by country, and it may also vary inside a country between different territories. You may review the estimated delivery time for your country at https://www.reima.com/int/shipping; please note that the indicated delivery times are always estimates and can be longer for example in connection with public holidays or sale. The estimated delivery times shall be calculated as of the date of the Order Confirmation. The delivery time will not exceed 30 days, unless Reima has specifically agreed upon longer delivery period with you.

Countries outside the European Union

If, after sending the Order Confirmation, We learn that for any reason We cannot ship within the 30 days, We will notify you of the new shipment date, tell you that We do not know when We can ship the Product, or, at Our option, cancel your order and send you a refund of the payment We have received for the Product within seven working days after the order is cancelled. If we give you a new shipment date, we will also seek your consent to the delayed shipment. If We are unable to obtain your consent to the delay, We will, without being asked, promptly refund all the money you paid Us for the unshipped Products. If we are unable to inform you when we can ship the Product, we will inform you of the reason for the delay, and you will have the right to cancel your order at any time until we have shipped the Product. If you do not respond to Our notice of delay, your order will be cancelled automatically within 60 days from the date of the Order Confirmation.

9) Defects in delivery or Products

Reima shall be liable for the defects in delivery and the delivered Products in accordance with the applicable mandatory law. If the Products you have received are defective, do not correspond to the ones you have ordered, or if your delivery is incomplete or damaged in transportation, please contact Reima’s customer service without delay. Please see https://www.reima.com/int/return-policy for more detailed instructions in relation to claims.

In case of such shipping errors or in case the Products you have received are proven to be defective, as defined in the applicable mandatory law, Reima shall rectify such non-conformities without undue delay. In the event that the claim leads to the Products being returned to Reima, Reima shall be liable for the costs of delivery caused by such return.

10) Right of withdrawal / Right to return

Countries within the European Union

For orders shipped to countries within the European Union, you have the right of withdrawal within 14 calendar days from the date of receipt of the ordered Products. If you wish to exercise your right of withdrawal you must contact our customer service within the said time period by email. You may also use the form available at the Shop and provided to you in connection with the Order Confirmation. Please see https://www.reima.com/int/return-policy for more detailed instructions in relation to returns.

Return of Products must be done to the address specified by Reima without any delay and latest within 14 days from the date of your notice of withdrawal.

The countries for which free returns apply in connection with the use of right of withdrawal have been specified at https://www.reima.com/int/return-policy. Except where you have a right to free return, or in case the Products you have received are proven to be defective, you are responsible for the payment of any and all direct costs incurred in returning the Products to Reima.

You are responsible for handling the Products diligently while they are at your care. You must diligently pack the Products for return shipment so that they will not be damaged. We recommend using the original packing. If you are no longer in possession of the original packaging, please use suitable packaging with sufficient protection against shipping damage. All accessories and packaged components must be returned together with the returned Products. In case you have used the Product, or handled or packed them negligently, or otherwise handled the Products other than what is necessary to establish the nature, characteristics and functioning of the Products, you are responsible for compensating the possible reduction of value of the returned Products up to the full price of such Products.

When you have exercised your right of withdrawal, Reima refunds the payment it has received for the Products except those additional charges that are due because you have selected other shipment method than the offered standard lowest price shipment method (in case of free returns). The refund is processed within 14 days from the receipt of your notice of withdrawal and is made in the same payment method that you have used when you ordered the Products. You will not incur additional costs for refunds. Reima has the right to suspend the payment of the refund until Reima has received the returned Products or You have proved to Reima that You have shipped the Products.

Unfortunately Reima does not offer exchanges.

Countries outside the European Union

For orders shipped to countries outside the European Union, you have the right to return Products within 14 calendar days from the date of receipt of the ordered Products. If you wish to exercise your right to return you must contact our customer service within the said time period by email. You may also use the form available at the Shop and provided to you in connection with the Order Confirmation. Please see https://www.reima.com/int/return-policy for more detailed instructions in relation to returns.

Return of Products must be done to the address specified by Reima without any delay and within 14 days from the date of your notice of return.

For orders shipped to countries outside the European Union, you are responsible for the payment of any and all direct costs incurred in returning the Products to Reima. Please note that Reima will not refund original shipping costs, customs duties and/or taxes. However, Reima will refund the original shipping costs to countries outside the European Union in case the Products you have received are proven to be defective. In such case, please contact Reima’s customer service without delay.

11) Intellectual property rights

All intellectual property rights, title and interest in and to the Shop (including without limitation any trademarks, text, Products, graphics, designs, catch phrases, concepts, artwork, sounds, musical compositions and audio-visual effects or computer code) are either owned or licensed by Reima. Reima reserves all rights, including without limitation, all intellectual property rights or other proprietary rights, in connection with the Shop.

12) Force majeure

Reima is not responsible for any non-performance attributable to a cause beyond Reima’s control that Reima could not reasonably take into account at the time of conclusion of the contract and the effects of which Reima cannot reasonably avoid or overcome.

13) Limitation of liability

The Shop is provided on an “as is” basis without warranties of any kind. While We use reasonable endeavors to verify the accuracy of any information We place at the Shop, We make no warranties, whether express or implied in relation to its accuracy. Reima shall not be held liable for any errors, interruptions, inaccuracies, deficiencies or other effects, delays or lack of correctness of the information contained at the Shop. To the fullest extent permitted by mandatory applicable law, We disclaim any and all warranties of any kind, whether express or implied, and any conditions or other terms other than those which are expressly mentioned in these Terms. In particular, We will not be responsible for ensuring that the Products are fit for your intended purpose.

To the extent permitted by the mandatory applicable law, We do not assume any liability, whether in contract, tort or otherwise for any special, punitive, consequential or indirect losses, or any economic losses, loss of data, loss of goodwill or reputation or any other kind of loss or damage of any kind howsoever arising from the use of the Shop or of the contents thereof, or from prevention of the said use, or from these Terms, regardless of whether the said damage is based on an agreement, infringement of rights or other grounds.

Please note that these Terms do not affect your statutory rights as a consumer, which cannot be waived or limited by contract. Further, nothing in these Terms excludes or limits liability or implied warranties which may not be lawfully limited or excluded under the applicable mandatory law, including but not limited to liability, which has been caused intentionally or with gross negligence.

14) Third party links

The Shop may link to websites or services operated by third parties. However, even if the third party is affiliated with Reima, we have no control over these linked websites or services, all of which have separate terms and conditions of use and/ or privacy and data collection practices independent of Reima. These linked websites and services are only for your convenience and therefore you access them at your own risk.

15) Severability

If any part of these Terms is unenforceable (including any provision in which We exclude our liability to you) the enforceability of any other part of these Terms shall not be affected and all other clauses shall remain in full force and effect. So far as possible, where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

16) Governing law and dispute resolution

These Terms, the Shop and the transactions concluded through the Shop are governed by and construed in accordance with the laws of Finland, unless otherwise stipulated by the applicable mandatory law.

Countries in the European Union, Norway and Iceland

All disputes arising out of or relating to these Terms, the Shop and the transactions concluded through the Shop shall be primarily settled by negotiations between us. If the dispute cannot be resolved amicably between us, you can consult the consumer advisory services of the Finnish Competition and Consumer Authority (https://www.kkv.fi/en/consumer-advice/) and also seek the recommendation of the said authority’s Consumer Disputes Board (http://www.kuluttajariita.fi/en/index.html). As a resident in the EU, Norway and Iceland you may also consult the European Consumer Centre at your country of residence.

As a resident in the EU, Norway and Iceland you may also refer the dispute to be resolved by the alternative dispute resolution body via the Online Dispute Resolution Forum at the address http://ec.europa.eu/odr. Please use our e-mail address customerservice@reima.com in connection with the proceedings.

Additionally you have the right to submit a dispute to be resolved at the district court of Vantaa or, provided that we deliver Products to or otherwise conduct business in the country where you are permanently resident or domiciled, to the court of first instance of that country.

Countries outside the European Union (excl. Norway and Iceland)

All disputes arising out of or relating to these Terms, the Shop and the transactions concluded through the Shop shall be primarily settled by negotiations between us. If the dispute cannot be resolved amicably between us, all disputes arising out of or relating to these Terms, the Shop and the transactions concluded through the Shop shall be finally resolved by the district court of Vantaa, Finland, as the court of first instance.
